Terms of Service

These Terms of Service ("Terms") are an agreement between you and John 812 LLC ("BlueMarble," "we," "us," or "our") governing your use of the BlueMarble SAT-practice app and website (the "Service"). Please read them carefully.

1. Acceptance of these Terms

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. The Service is not directed to and may not be used by children under 13. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Service, you represent that you meet these requirements.

3. Your account and responsibilities

• You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use.
• You may sign in using an email and password, a sign-in link or code we email you, Google, or Apple. You agree not to share your account or let others use it.
• One person, one account, unless we agree otherwise.
• Usernames. If you choose a username, it must not impersonate anyone or be offensive. We may change or remove a username that breaks these Terms.
• Friends and sharing. Adding friends and sharing your progress are optional. When you add a friend, or share your progress with a parent or tutor, you are choosing to show them the information described in our Privacy Policy. Only invite people you know and who would expect to hear from you.
• Parent accounts. A parent account lets you see the progress of students who have chosen to share it with you. Use what you see only to support that student, and do not pass it on to others without their agreement.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Harass other users, or use usernames, friend requests, or invitations to send unwanted or abusive messages;
• Copy, scrape, resell, or redistribute questions, explanations, or other content from the Service, except for your own personal study;
• Attempt to access accounts, data, or systems that are not yours, or probe, scan, or test the vulnerability of the Service;
• Interfere with or disrupt the Service, including by overloading, injecting malware, or bypassing rate limits or security controls;
• Reverse engineer or attempt to extract source code except to the extent this restriction is prohibited by law;
• Use automated means to access the Service in a way that harms it or other users.

5. Intellectual property

The Service and its content — including SAT-practice questions, explanations, software, text, graphics, and the BlueMarble name and logo — are owned by BlueMarble or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own SAT preparation. All rights not expressly granted are reserved. "SAT" and related marks are the property of their respective owners; BlueMarble is not affiliated with or endorsed by the College Board.

Any data you enter (such as self-reported scores) remains yours; you grant us the limited rights needed to store and process it to provide the Service, as described in our Privacy Policy.

6. Disclaimers

No score guarantee. BlueMarble is a practice tool. We do not guarantee any particular SAT score, score improvement, admission, or other outcome. Your results depend on many factors outside our control. Estimated scores and diagnostics are approximations for study purposes only and are not official SAT scores.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any content is accurate or complete.

7. Limitation of liability

To the maximum extent permitted by law, BlueMarble and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the service. To the maximum extent permitted by law, our total liability for any claim relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the claim, or fifty U.S. dollars (US$50).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Termination

You may stop using the Service and delete your account at any time from the app's Account screen. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

9. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules, and you and BlueMarble agree to the exclusive jurisdiction of the courts located there for any dispute not subject to another agreed process.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take additional steps to notify you where appropriate. Your continued use of the Service after an update means you accept the revised Terms.
